1.1.    Images remain the copyright of Katie Fergus at all times.  Images are licensed to  the client for an agreed usage and timeframe. 

1.2.    All image usage must be disclosed prior to the shoot. Images are to be used for the agreed upon usage only and any extra usage will incur fees.

1.3.    If there is no written agreement prior to the shoot images are for digital usage only for the booking client, no other client brand or publication for a period of 12 months.

           1.3.1. Website, Blog and Social media - no print media, marketing or advertising. No TVC or Billboard.

1.4.    All delivered images are intended for the sole clients usage and are therefore not to be passed on to any other client, brand or publication or without appropriate permissions and licences.

           1.4.1. Sole Client - The booking and paying client

2.1.    Once a shoot date has been confirmed, the booking date is final and changes may incur fees. 

2.2.    All new clients may be required to pay a 50% deposit to secure the booking which must be paid prior to the commencement of the shoot.

2.3.    If the booking falls on a weekend or public holiday a 50% deposit may be required to secure the booking which must be paid prior to the commencement of the shoot.

2.4.    Any outstanding payments are due immediately after completion of the shoot date. Images may be withheld until payment is recieved in full. 

2.5.    Any late payments will incur a $100 +GST per week or part thereof fee accrual until payment is made in full with remittance.

3.1.    If any equipment or studio hire is booked, payment must be made prior to the shoot to Katie Fergus or directly to the supplier in order to secure the booking.

3.2.    Bookings will not be guaranteed until suppliers have received payment.

3.3.    Studio and equipment hire cannot be refunded if shoot is cancelled or rescheduled.

4.1.    Should you need to reschedule a fee of $150 is charged if less than 48 hours notice before the scheduled start time of the shoot is provided. 

4.2.    Wet weather is not charged a reschedule fee for the first reschedule, but charged $150 for every reschedule there after if less than 24 hours notice prior to shoot start time is provided.

4.3.    Should you need to cancel without rescheduling with less than 3 days notice prior to the scheduled start time of the booking, a 50% cancellation fee of the total booking will be charged.

4.4    If less than 24 hours notice is given prior to the scheduled shoot start time of the booking, a cancellation fee of 100% of the total booking costs will be charged. 

4.5    Studio and or equipment hire cannot be refunded.

5.1.    All travel costs need to be paid prior to the commencement of the shoot to secure the booking. 

5.2.    All travel related costs are non refundable in the event of rescheduling or cancellation.

5.3.    If for any reason the shoot needs to be rescheduled - including weather - all relevant travel costs to reschedule the date will be required to be covered in full prior to the rescheduled shoot date.

6.1.    All videography requires a 50% deposit to be paid prior to the commencement of the shoot.

6.2.    Turnaround of up to 30 business days for first cut and final cut of up to 15 business days following any feedback. All collateral including logos, company colours, fonts and style guides must be supplied before the commencement of post production or timeline for delivery will be delayed.

6.3.    All video include one round of corrections by author once first cut files have been supplied, any further rounds will be charged as author’s corrections by the hour.

6.4.    Videos will only be made using royalty free music unless there is expressed permission from the artist and valid license can be provided.

7.1.     If a deposit is required, Images will not be delivered to the client until deposit has been received. 

7.2.    Turnaround of images is up to 15 business days for first selects and any further retouching is is dependant on how extensive edits are.

7.3.    All images are delivered in requested image size, colour graded and minimally retouched.

7.4.    Digital usage image delivery size is 2500px wide by 72dpi unless otherwise stated. 

7.5.    All images are delivered via Dropbox and stored on there for six months from shoot date. After 6 months images are removed or archived at the discretion of the photographer.

7.6.  Any archived images will incur an archival retrieval fee if images need to be redelivered.
